Fair Use Policy

ExtaHost is a service operated by FPM Labs LLC, registered in Wyoming, United States.

Unmetered bandwidth is subject to fair use. Excessive usage that negatively impacts network performance may result in limitations or service adjustments.

This Fair Use Policy ("Policy") governs the acceptable use of ExtaHost services and forms part of ExtaHost's Terms & Conditions. All services are subject to fair and reasonable use of shared infrastructure resources.

1. Overview

ExtaHost provides access to shared infrastructure resources, including bandwidth, CPU, memory, and disk I/O.

Where services are advertised as unmetered or unlimited, this refers to usage without predefined transfer limits, not unlimited or guaranteed access to physical resources.

Usage must remain within reasonable limits to ensure:

• Network stability
• System performance
• Fair access for all customers

2. Normal Usage

Most customers will never be affected by this Policy.

Normal usage includes, but is not limited to:

• Remote Desktop (RDP) access
• VPS usage for development or testing
• Website and application hosting
• General business workloads
• Bursty or intermittent resource usage
• File transfers related to normal operations

These use cases typically consume low to moderate resources and are fully supported.

3. Excessive or Abusive Usage

Fair use does not permit sustained or disproportionate consumption of shared resources.

The following may be considered excessive or abusive if they negatively impact infrastructure or other customers.

Bandwidth

• Sustained high-bandwidth usage over extended periods
• Continuous line-rate traffic (e.g. 24/7 saturation)
• Torrenting, seedboxes, or file distribution services
• Streaming, mirroring, or download relay services
• Public proxy, VPN resale, or traffic relay usage

CPU & Memory

• Continuous high CPU usage inconsistent with normal VPS or RDP workloads
• Use of services primarily for compute-heavy batch processing
• Cryptomining or similar workloads (authorized or unauthorized)
• Usage patterns that degrade host performance for other customers

Disk I/O

• Sustained high disk I/O usage impacting storage performance
• Use of services primarily for file serving, mirroring, or backup targets
• Disk abuse resulting in elevated latency for other services

4. Fair Use Enforcement

If a service is determined to exceed fair use, ExtaHost may take one or more of the following actions at its sole discretion:

• Contact the customer to discuss usage
• Apply temporary or permanent rate limits
• Restrict specific resources (e.g. bandwidth or I/O)
• Require a service upgrade or custom resource allocation
• Suspend or terminate the service in cases of severe or repeated abuse

Enforcement actions are based on actual resource impact, not arbitrary thresholds.

5. Relationship to Other Policies

This Fair Use Policy must be read together with:

• Terms & Conditions
• Abuse Policy
• Refund Policy

Violations of this Policy may also constitute violations of those policies and may result in:

• Loss of refund eligibility
• Immediate suspension or termination
• Permanent account suspension in severe cases

6. Transparency & Intent

ExtaHost does not enforce automatic overage billing or predefined resource caps under this Policy.

Our intent is to:

• Maintain a reliable, high-quality platform
• Prevent abuse and misuse of shared resources
• Allow legitimate customers to operate without unnecessary restrictions

This Policy exists to protect the platform — not to penalize normal customers.

7. Policy Updates

ExtaHost reserves the right to update this Fair Use Policy at any time to reflect changes in infrastructure, capacity, or industry standards.

Continued use of ExtaHost services constitutes acceptance of the current version.
